Copyrighted Stuff at School

Postby Richard_Benoit on Mon Jan 23, 2012 3:17 pm

Anyone ever get flagged or had a copyright issue with some of the art or materials in their lessons, worksheets or English newsletters? I know that Japanese law and American law are kind of similar with the "fair use" sections which cover educational use. But these clauses are fuzzy at best, and almost every situation is different.

My fukocho is cool about all that but mentioned it in passing when I was browsing clip art today. I am known for using cut-outs of famous characters to drive home my point when teaching a lesson point.

I'd imagine Japanese law is pretty similar...

Are you sure s/he is not just taking the piss? I have had teachers joke when I made fake american money for a class, but none of them were actually worried.

Some places have both. I had a friend that went to a huge school that had Kocho, fuku-kocho and two kyoto. Apparently one of the kyoto was for matters within the school and one kyoto was for matter from outside the school. Heady stuff really.

I knew that but was being a bit of a nazi because fu-kocho was what he wrote, not fuku-. The position of fuku-kocho is rather new, only within the past couple of years iirc.

Well paul lets just put it this way. I have one principal, and one vice principal. I was talking about my vice principal.

Not that it really changes anything.

And, like I said he just asked. Are those copyrighted images. To which I replied "some are some aren't" as I am browsing them through google.

Then he said, that the way I probably intend to use them was probably alright because of the educational use clause.

He wasn't stern at all, and I wonder if HE himself even cares. But as always, I get the feeling he is just looking out for me, we are pretty tight.

But all that aside, I was just wondering about all your experiences with this topic.

never had any issue, and never really cared about it. if we did, where would we get? I'm certainly not gonna study law and start finding out every original copyright holder of every picture I use, and try to find their contact and ask for permission, that might never come, or might come a year later... that's meaningless humbug
If they don't want their picture or whatever to be used by other people, they should note it on it, or otherwise not publish it in an open public media the whole world has access to.

Maybe it is humbug for educational works, but trust me it is not humbug in the real world. I has that as the holder of a copyright on my own book and because I had to all but stop writing my quote book because every famous thing everyone has said over the past 60 years is basically copyrighted (not really but it might as well be because it is untouchable without assent). Any way, long story short, it's always best to be on the safe side.

The same could be said for every piece of music, video, book, or whatever on the internet today. Hence the intense court, government, and legal battles being waged over copy right infringement.

Many times the authors themselves did not initially place the information on the 'net and are getting ripped off because people are not paying the royalties that usually would be forwarded to them for use of their registered product.

However for personal use I do believe that copying up to 1/3 of any publication is allowable under Japanese law. It could be up to half but I do not remember exactly.

Sure, that's why you usually have to pay for it (on legal sites).

BTW, people do know that there is an image gallery connected to this forum that houses a decent non-copyrighted image collection, right?
